Referendum Results
Voters on Tuesday overwhelmingly approved three statewide ballot proposals, including measures that expand criteria judges may consider when setting cash bail.
The first question broadens language in the state Constitution by authorizing judges to weigh "serious harm" to include more definitions such as grievous bodily harm and mental harm as criteria necessary to protect the community when setting conditions on a defendant's release before trial, giving judges more leeway to keep the community safe.
The second question allows judges to consider the “totality of circumstances” when determining the amount of cash bail for those accused of committing a violent crime. Until now, Wisconsin was the only state that limits a judge to a single factor when setting bail - flight risk. This amendment allows judges to consider one’s previous violent convictions and the safety of the community in addition to the probability that the defendant will return to court.
With violent crime from repeat offenders on the rise, it’s critical for judges to have all of the tools they need to keep our communities safe.
Additionally, nearly 80% of Wisconsin voters confirmed that able-bodied childless adults should be required to look for work as a condition of receiving taxpayer-funded welfare benefits.
With work search requirements, more individuals submit resumes for available jobs. Unfortunately, there's been an increase in “ghosting”, a practice in which an employer will contact a prospective employee for an interview, only to have that individual either not reply or not show up for the interview. This has made it extremely difficult for employers to find capable workers and has wasted a business’ valuable time and resources.
My colleague, Representative Jon Plumer (R - Lodi), has reintroduced legislation that will create a process for employers to report to the Department of Workforce Development (DWD) instances in which an individual declines an interview or job offer, fails to respond to an interview request or job offer, fails to attend a job interview without rescheduling, or a former employee is not available to return to work. DWD would then be required to investigate this claim. If a report is found to be credible, an individual on unemployment would be ineligible for unemployment for a week.

Article 1 in our Wisconsin State Constitution is our State Bill of Rights. So the referendums passed just restrained the God-given rights protected by the Constitution and expanded government power over the people.
Define mental harm. What happens when an abortion clinic accuses Pro-life protesters of committing mental harm against their "clients" as they stand outside peacefully protesting and praying against the murder of the unborn. What about if a robber survives the homeowner's defense of his castle and family only to sue the homeowner for violence and physical harm against him? How about when the transgender community accuses people of mental harm against those who disagree with them?
If our Representatives ever picked up the Constitution and read it or even referenced Frederic Bastiat's "The Law" or "That Which is Seen and That Which is Unseen", they would understand that the law is put in place to RESTRAIN injustice, NOT to promote justice. Due process of law, when in the power of a moral and virtuous judiciary, means that you are innocent until proven guilty and that an ACCUSED person has not been convicted of a crime. Therefore, the accused has full access to his/her God-given rights UNTIL they have been convicted in a court of law.
We have now restrained justice, given unlimited power to the judiciary and the legislature over our right to due process, and set the tone for future violations of God-given rights when immoral and activist judges and legislatures decide to attack the innocent to protect special classes.
